Francoise Gilbert is recognized as one of the world’s top legal experts in the areas of privacy and data security compliance, data governance, and risk management. She is the Founder and Chief Executive Officer of DataMinding Legal, headquartered in Silicon Valley, California. She currently focuses her research and analysis on the myriad privacy, security, and ethical issues raised by the use of Artificial Intelligence and Internet of Things technologies.
Qualified to practice law both in the United States and France, Ms. Gilbert assists clients in anticipating their data security, privacy, and information management obligations and in addressing these obligations in the context of their business and revenue objectives. Projects include, among others, framing and designing disclosures and compliance programs to meet the most recent legal developments, such as the California Consumer Protection Act and the European General Data Protection Regulation; structuring Data Protection by Design and by Default processes for use in managing the development of new products; and implementing practical structures to address global operations and cross-border data transfer restrictions.
Ms. Gilbert received the 2019 Vanguard Award (California Lawyers Association) in recognition of her pioneering work in the area of data privacy and security law. She has also received numerous accolades from her peers acknowledging her thought in leadership and extensive experience in identifying and addressing the new, unique privacy, and data security legal issues raised by emerging technologies. She has been recognized by the National Law Journal as a Privacy & Cybersecurity Trailblazer and by Best Lawyers as a “San Francisco Best Lawyer of the Year” in the area of Data Protection. She was recognized for 10 successive years by the prestigious Chambers USA and Chambers Global as one of the leading lawyers in the field of information privacy and security. Previously, she was selected as one of “Northern California’s Top Attorneys” and ranked as one of the top 10 privacy advisers in the Computerworld “ Best Privacy Advisers” list. She has also been selected by her peers for inclusion in The Best Lawyers in America (since 2008) and Who’s Who in E-Commerce and Internet Law (since 1999) in the areas of information technology and data privacy and cybersecurity. Ms. Gilbert has co-chaired the PLI Privacy & Security Law Institute since its creation in the late 1990s, and the Silicon Valley KnowledgeNet of the International Association of Privacy Professionals (IAPP) from 2004 to 2012. She is regularly invited to speak at conferences in Asia, Europe, and the United States and to comment on burning issues. A graduate from Loyola University of Chicago School of Law (Juris Doctor) and the University of Paris (France) (Maîtrise en Droit), Ms. Gilbert is certified as a CIPP/US, CIPP/EU, and Certificate in Investment Performance Measurement by the IAPP. She holds undergraduate and graduate degrees in Mathematics and Education ( Maitrise es Sciences Mathématiques and CAPES Mathématiques) from the University of Montpellier (France) and the University of Paris (France), and is admitted to practice law in the United States (California Bar and Illinois Bar) and in France (Paris Bar).
