The Virginia Minimum Wage Act is amended relating to tipped employees. Under the Act, an employer may not classify an individual as a tipped employee if the individual is prohibited by federal or state law or regulation from soliciting tips. “Tipped employee” is defined to mean an employee who in the course of employment customarily and regularly receives tips totaling more than $30 each month from persons other than the employee's employer. Section 40.1-28.9 is amended. (Ch. 1145 (H.B. 56), L. 2020, effective July 1, 2020).
