The Office of Management and Budget has received for review the DOL’s proposed rulemaking, "Tip Regulations Under the Fair Labor Standards Act (FLSA)," which, if finalized, would align with the FLSA provisions previously amended under the FY 2018 Consolidated Appropriations Act. Those provisions concern employers’ use of tips and render parts of the DOL’s 2011 tip rule—which predated Acosta’s tenure and also stirred up substantial controversy—without force or effect until future action by the DOL.
