New York appellate court upholds paycard rules

Previously, the Supreme Court of New York in Albany County ruled that the repeal of the paycard rules by the State of New York Industrial Board of Appeals (Docket No. PR 16-120, February 16, 2017) (see Payroll Management Guide Report Letter 1488/2495, dated February 28, 2017) was arbitrary and capricious and therefore annulled. (Reardon v. Global Cash Card and New York State Industrial Board of Appeals, No. 2643-17 (NY Sup. Ct., Alb. Cty. (5-23-18).) The New York Appellate Division, Third Department has upheld the repeal. Thus, the regulations remain in effect. (Reardon v. Global Cash Card et al., 2020 NY Slip Op 00187, January 9, 2020).
