VA Rule Adds Personal Identity Verification Clause

The Department of Veterans Affairs has finalized, without substantive change, a proposed rule (¶73,010.37) addressing administrative and information matters, publicizing contract actions, and contract terminations. The rule removes and reserves VAAR Part 805, Publicizing Contract Actions, and revises VAAR Part 849, Termination of Contracts. Also, the rule adds VAAR 804.1303 to create a prescription for a new contract clause at VAAR 852.204-70, Personal Identity Verification of Contractor Personnel. The clause, which will be used in contracts that require contractor employees to have routine access to a VA facility or to VA information systems, requires contractors to comply with current VA policy for personal identity verification for all employees performing under a contract.

Mortuary Services Clause. Further, the rule revises the clause at VAAR 852.249-70, Terminations for Default—Supplement for Mortuary Services, and its prescription at VAAR 849.504-70. Finally, the rule removes and reserves VAAR Subpart 804.1, Contract Execution, and VAAR Subpart 849.1, General Principles. VA issued the rule in connection with its initiative to amend and update the VA Acquisition Regulation in phased increments to revise policy superseded by Federal Acquisition Regulation changes, move internal VA procedural guidance to the VA Acquisition Manual, and incorporate new agency-specific regulations and policies.
