SBA Considering Two Nonmanufacturer Rule Waivers

The Small Business Administration is considering requests for class waivers of the nonmanufacturer rule (SBA 121.406(b)) for commercially handheld land mobile radios under North American Industry Classification System code 334220/Product Service Code 7830, and leather holsters (M18 System) and accessories under NAICS code 316998/PSC 8465. According to the requests, no small business manufacturer can supply these products to the federal government. If granted, the class waivers would allow otherwise qualified regular dealers to supply the waived items, regardless of the business size of the manufacturer, on a contract set aside for small business, service-disabled veteran-owned small business, women-owned small business, economically-disadvantaged WOSBs, historically underutilized business zones, or participants in the 8(a) Business Development program. Comments and source information are due February 21, 2020, for the NAICS 334220 request (85 FR 3739), and February 24, 2020, for the NAICS 316998 request (85 FR 4054).
