Final DFARS Rule Modifies Surge Option Clause

By Government Contracts Editorial Staff

The Department of Defense has issued a final rule amending the Defense Federal Acquisition Regulation Supplement. The DFARS Case 2018-D025 final rule modifies the contract clause at DFARS 252.217-7001, Surge Option, to reflect current terminology and industry practices, pursuant to action taken by the DoD Regulatory Reform Task Force. Specifically, the rule replaces the term “Production Surge Plan (DI-MGMT-80969)” with “Capabilities Analysis Plan (CAP)” and adds text to permit the option increase of supplies or services called for under the clause to be expressed as a specific number. The final rule makes no changes to the proposed rule (¶70,020.410). For the text of this rule, effective December 4, 2018, see ¶70,016.963.
