FAR Rule Addresses Electronic Commerce

The FAR Case 2018-022 rule finalizes a proposed rule (¶70,006.341) without changes to amend the clause at FAR 52.216-18 to allow the issuance of task or delivery orders via fax or electronic commerce and clarify when an order is “issued” under these methods. The clause is included in solicitations and contracts when an indefinite-delivery definite-quantity, requirements, or indefinite-delivery indefinite-quantity contract is contemplated. The rule reflects current business practices in the ordering process by updating FAR 52.216-18 to no longer require a separate authorization in the contract to use electronic commerce or fax to issue task or delivery orders. As a result, COs no longer need to include supplemental ordering language in the contract when anticipating the use of fax or electronic commerce to issue task or delivery orders.
