The Civilian Agency Acquisition Council and the Defense Acquisition Regulations Council have issued Federal Acquisition Circular 2019-02, which contains final rules amending the Federal Acquisition Regulation. The FAR Case 2018-015 rule removes the requirement to make a best procurement approach determination to use an interagency acquisition. The determination was required prior to requesting another agency to conduct an acquisition, and before placing an order against another agency’s indefinite-delivery contract vehicle. This requirement was implemented in FAR 17.502-1(a). Accordingly, this rule removes FAR 17.502-1(a) and redesignates paragraphs (b) and (c) as paragraphs (a) and (b) respectively. The rule also removes references to FAR 17.502-1(a) in FAR 4.603, FAR 8.404, and FAR 35.017-3. The rule implements section 875 of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (PL 115-232), which amended section 865 of the Duncan Hunter NDAA for FY 2009 (PL 110-417).
