Executive Order Seeks to Accelerate Infrastructure Projects

Executive Order 13927, Accelerating the Nation’s Economic Recovery From the COVID-19 Emergency by Expediting Infrastructure Investments and Other Activities, seeks to prevent a protracted economic recovery and persistent high unemployment as a result of the COVID-19 outbreak. The June 4, 2020, order states that agencies should take all reasonable measures to speed infrastructure investments and other actions that will strengthen the economy and return Americans to work. Section 3 of the order, Expediting the Delivery of Transportation Infrastructure Projects, instructs the Secretary of Transportation to use all relevant emergency and other authorities to expedite work on, and completion of, all authorized and appropriated highway and other infrastructure projects.

Expedited Decision Making. Section 4 of the order, Expediting the Delivery of Civil Works Projects Within the Purview of the Army Corps of Engineers, directs the Secretary of the Army to use relevant emergency and other authorities to expedite work on, and completion of, authorized and appropriated civil works projects. The secretaries must provide summary reports listing all projects that have been expedited within 30 days of the order. Another section of the order directs agency heads to expedite other infrastructure, energy, environmental, and natural resources projects on federal lands. Finally, the order instructs agencies to consider statutory and regulatory flexibilities that allow for expedited government decision making in exigent circumstances, set forth in the National Environmental Policy Act (42 USC 4321, and following) the Endangered Species Act (16 USC 1531, and following), the Clean Water Act (33 USC 1344), and other authorities.
