DOE Updates Contractor Employee Protection Program

By Government Contracts Editorial Staff

The Department of Energy has finalized a proposed rule (84 FR 18164) amending its Contractor Employee Protection Program. The program extends whistleblower protections similar to those in the Whistleblower Protection Act to employees of DOE contractors and subcontractors. DOE’s Office of Hearings and Appeals regulations, which are located at 10 CFR 708, contain the procedures for processing complaints by employees of DOE contractors alleging employer retaliation for disclosure of information concerning danger to public or worker health or safety, substantial violations of law, or gross mismanagement; for participating in Congressional proceedings; or for refusing to participate in dangerous activities (10 CFR 708.1). The final rule revises these procedures in their entirety. The rule goes into effect October 1, 2019. For the text of the rule, see 84 FR 37752.
