The Department of Labor has issued a direct final rule (¶70,375.11), with a request for comments, and a notice of proposed rulemaking (¶70,375.12), amending three definitions in the Department of Labor Acquisition Regulation and providing the Secretary of Labor with greater flexibility and a streamlined procedure to delegate procurement authority and appoint procurement officials. Currently, the definitions in DOLAR 2902.101 delegate the Secretary’s procurement authority to specified department officials. The changes remove some of those specific designations, allowing the Secretary to delegate the Secretary’s procurement authority and assign roles and responsibilities related to procurement through internal guidance, without the need to revise the DOLAR. Accordingly, the rule amends the definitions of “Head of Agency,” “Head of Contract Activity,” and “Senior Procurement Executive.” Comments on the proposed rule are due September 30, 2019. The final rule goes into effect October 28, 2019, unless DOL receives significant adverse comments on the proposed rule.
