The Department of Defense has issued Class Deviation 2019-O0012, Use of DLA Energy as a Source for Fuel. The notice provides that, notwithstanding the restriction at FAR 51.101(a)(1), contracting officers may authorize contractors to use Defense Logistics Agency Energy as a source for fuel for performing other than cost-reimbursement contracts, if the fuel is funded by the Defense Working Capital Fund. To use this authority, COs must: comply with the requirements of FAR 51.102 and DFARS 251.102, including the execution of a letter of authorization; include the clauses at FAR 52.251-1, Government Supply Sources, and DFARS 252.251-7000, Ordering from Government Supply Sources, in the contract; obtain a current fuel purchase authorization template from DLA Energy; and email specified documentation to DLA Energy.
