Class Deviation Addresses Commercial Items

The Department of Defense has issued a class deviation. Class Deviation 2018-O0016 implements section 879 of the National Defense Authorization Agreement for Fiscal Year 2017 (PL 114-328). This deviation authorizes contracting officers to acquire innovative commercial items, technologies, or services using a competitive procedure called a commercial solutions opening. Under a CSO, DoD may competitively select proposals received in response to a general solicitation, similar to a broad agency announcement, based on a review of proposals by scientific, technological, or other subject-matter expert peers. Items, technologies, and services acquired using a CSO must be treated as commercial items. Also, notwithstanding the limitations in DFARS 235.006-71, a CSO may be used to fulfill research and development requirements. The deviation also outlines the procedures governing the use of CSOs. This class deviation went into effect on June 26, 2018.
